Terms of Use — Atma Sanatan

Welcome to Atma Sanatan. These Terms of Use ("Terms") constitute a legally binding agreement between you and AtmaSanatan ("we", "us", "our"), governing your use of the Atma Sanatan mobile application and any related services (collectively, the "Service").

By downloading, installing, or using the app, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

The Atma Sanatan app is designed for all ages and contains devotional, spiritual, and educational content appropriate for the whole family. You may use the app as a guest without registration. Creating an account requires a valid phone number and is intended for users aged 13 and above. If you are under 13, you may use the app in guest mode to access freely available content.

If you are using the Service on behalf of a minor in your care, you accept these Terms on their behalf and take responsibility for their use of the Service.

2. Account Registration

Account creation is phone-number based. By providing your phone number, you authorise us to send a one-time password (OTP) for verification. You are responsible for:

Keeping your account credentials secure and not sharing them with others.
All activity that occurs under your account.
Notifying us promptly at legal@atmasanatan.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent, abusive, or harmful activity.

3. Content and Licence

3.1 Our Content

All content available through the Service — including shlokas, bhajans, mantras, stotrams, aartis, chalisa, audio recordings, translations, explanations, articles, wallpapers, and other media — is owned by or licensed to AtmaSanatan, or is in the public domain. Some content, particularly translations, summaries, and audio narrations, is produced or refined through automated computational processes and reviewed for accuracy and reverence to the traditions it represents.

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the content for your own private, non-commercial, devotional and educational purposes. This licence does not permit you to:

Copy, reproduce, distribute, or publicly display any content without our written permission.
Modify, create derivative works from, or commercially exploit any content.
Scrape, harvest, or systematically download content from the app or our servers.

3.2 Wallpapers

Wallpapers downloaded through the app are licensed for personal device use only. They may not be redistributed, sold, or used in any commercial context without prior written consent.

3.3 User-Generated Content

The app does not currently support user-generated content. If this feature is introduced in the future, these Terms will be updated accordingly.

4. Spiritual Content Disclaimer

The content on Atma Sanatan — including shlokas, mantras, explanations, and articles — is provided for devotional, educational, and informational purposes only. It does not constitute religious advice, spiritual guidance from a qualified guru, or any form of professional counsel.

We make reasonable efforts to ensure the accuracy and reverence of all content to the traditions it represents, but we do not guarantee that every translation, interpretation, or commentary reflects the full depth or authoritative position of any particular lineage, tradition, or scholarly body. Users are encouraged to consult qualified religious scholars or spiritual teachers for matters of personal practice and guidance.

5. Subscriptions and Payments

5.1 Free and Premium Content

A portion of the content on Atma Sanatan is available free of charge. Additional content, features, and capabilities may be unlocked through a subscription or one-time in-app purchase.

5.2 Subscriptions

Subscriptions are offered on a recurring basis (monthly or annual) and are managed through the platform store (Google Play or Apple App Store). By subscribing, you authorise the respective store to charge your payment method on a recurring basis at the then-current subscription price until you cancel. Prices are displayed before purchase and may change with reasonable advance notice.

To avoid being charged for the next renewal period, you must cancel your subscription at least 24 hours before the end of the current billing cycle through your store account settings. Cancellation takes effect at the end of the current period; you retain access to premium features until that date.

5.3 In-App Purchases

One-time in-app purchases (such as individual content packs or feature unlocks) are processed by the platform store and are generally non-refundable once the digital content has been accessed or downloaded, except as required by applicable law or the store's refund policy.

5.4 Donations

Atma Sanatan may offer a voluntary donation feature to support the app and the preservation of devotional content. Donations are entirely voluntary and do not entitle donors to any specific content, features, or benefits beyond what is already available under their existing access tier. Donations are generally non-refundable.

5.5 Free Trials

We may offer a free trial period for subscriptions from time to time. If a free trial is offered, its duration and any conditions will be stated at the point of sign-up. You will not be charged during the trial period. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the end of the trial at the then-current price. You may cancel at any time during the trial through your platform store account settings.

5.6 Refunds

All subscription and purchase transactions are subject to the refund policy of the platform store through which the purchase was made. We do not process payments directly and cannot issue refunds independently of the platform store. For refund requests, please contact Google Play or Apple App Store support directly. If you believe you have been incorrectly charged, contact us at legal@atmasanatan.com and we will assist within our ability.

6. Advertising

The free tier of the app may display third-party advertisements in the future. If and when advertising is introduced, we will update these Terms and our Privacy Policy, and provide appropriate notice to users. Third-party ad networks may use cookies or advertising identifiers to serve relevant advertisements; we will provide opt-out mechanisms as required by applicable law. We do not sell your personal data to advertisers.

7. Prohibited Conduct

When using the Service, you agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
Attempt to gain unauthorised access to any part of the Service, other user accounts, or our servers and systems.
Interfere with or disrupt the integrity or performance of the Service.
Use automated tools (bots, scrapers, crawlers) to access or extract content from the Service.
Reverse-engineer, decompile, or disassemble any part of the app.
Use the Service to transmit harmful, offensive, or infringing content.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Circumvent any content protection, access control, or subscription enforcement mechanisms.

8. Intellectual Property

All intellectual property rights in the Service and its content — including the Atma Sanatan name, logo, app design, user interface, software, and original content — are owned by or licensed to AtmaSanatan. Nothing in these Terms transfers any ownership of such rights to you.

Ancient scriptures, mantras, and shlokas are part of humanity's shared spiritual heritage and are in the public domain. Our original translations, audio renditions, explanations, artwork, and editorial curation remain our intellectual property.

9. Third-Party Services and Links

The Service integrates with or links to third-party services, including platform stores, analytics providers, payment processors, OTP delivery services, and content API providers. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, policies, or practices of any third party.

If the app includes links to external websites, following those links is at your own risk. We do not endorse or assume responsibility for any external content or services.

10. Disclaimers and Limitation of Liability

10.1 No Warranty

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10.2 Limitation of Liability

To the fullest extent permitted by applicable law, AtmaSanatan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including loss of data, loss of revenue, or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or ₹1,000 (Indian Rupees one thousand), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages. If you are located in such a jurisdiction, the above limitations apply only to the extent permitted by local law.

11. Availability and Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, for maintenance, updates, or any other reason. We will endeavour to provide reasonable advance notice of significant changes or discontinuation.

We may also update these Terms from time to time. We will notify you of material changes through an in-app notice or push notification. Continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms.

12. Termination

You may stop using the Service and delete your account at any time by contacting us at legal@atmasanatan.com.

We may suspend or terminate your access to the Service with immediate effect if you breach these Terms, engage in fraudulent or abusive behaviour, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall continue to apply.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019. Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

14. Indemnification

You agree to indemnify, defend, and hold harmless AtmaSanatan, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit or transmit through the Service.

We reserve the right to assume exclusive control of the defence of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claim.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic or epidemic, power failure, internet or telecommunications outages, third-party service disruptions (including platform store outages), civil unrest, government action, or any other event that could not have been reasonably anticipated or prevented.

In such circumstances, our obligations will be suspended for the duration of the force majeure event. We will make reasonable efforts to resume performance as soon as practicable.

16. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time — for example, in connection with a merger, acquisition, reorganisation, or sale of assets — without notice to or consent from you. Any assignment in violation of this section is void.

17. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AtmaSanatan with respect to your use of the Service, and supersede all prior or contemporaneous agreements, representations, or understandings — whether written or oral — relating to that subject matter. Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision.

18. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the following Grievance Officer is appointed to address complaints and grievances relating to the Service:
